This website is owned by Limited Liability Company “Marchenko Danevych Law Firm” (“Marchenko Danevych”), a legal entity incorporated under the laws of Ukraine, company code 37026380, registered and located at the address: 4-B Ivana Franka Street, 1st floor, office 49, Kyiv 01034, Ukraine.

Both the Terms of Use and the Privacy Policy may be changed from time to time – you may see the date of the last change at the beginning of this page.

Please note that by using our website and/or sharing information about yourself with us, you confirm that you fully accept and agree to both these the Terms of Use and the Privacy Policy.

These Terms of Use and Privacy Policy are governed by the laws of Ukraine. 

Any disputes that arise under or in connection with these Terms of Use and/or the Privacy Policy shall be resolved through negotiations. If negotiations fail, any party may submit the dispute to the Ukrainian courts under the applicable procedural laws of Ukraine.

(1) Is information on this website a legal advice?

Any information and materials displayed on Marchenko Danevych website are for information purposes only and are not legal advice. To get legal advice specifically tailored to your needs and circumstances, please consult the Marchenko Danevych lawyers directly.

Marchenko Danevych shall not be held liable for any actions taken or any damages or claims or losses whatsoever that have or may have resulted from considering information and/or materials displayed on this website a legal advice and/or relying or using any information contained on the website.

If we find it necessary for the benefit of our visitors, we may include into our materials links to websites that are not operated and/or owned by us.

Since we do not operate/own these websites, we cannot be responsible for the content or security of such websites, or for the way they treat your personal information. Please consult the terms of use of these websites for more details.

Our website offers an opportunity to share the website’s content on social media (Facebook, LinkedIn, etc.). Once you click on the icon of a social network on our website, the terms of use of a particular social network will apply.

(3) How can you use materials on our website (also if you are a media representative)?

Information and materials on this website are protected by copyright law and, except for instances specified below, may not be used, copied, reproduced, changed, shared or distributed in any form by anyone without our documented consent.

You may copy, print out or download materials from our website for personal use only, provided that the name of the author, author’s position at Marchenko Danevych and source of the materials are stated on the material, and that no part of the material is modified in any way. 

If you are a journalist/reporter/other media representative, and you would like to re-publish/share any material from our website in whole or in part on the web or in printed media, you are free to do so if the above conditions are met. (4) Confidentiality of Marchenko Danevych messages 

Information contained in any Marchenko Danevych message, electronic or in any other form, including any attachments thereto (hereinafter - "message"), is strictly confidential and may contain privileged and/or proprietary information. If you have erroneously received such message, please notify the sender immediately and delete the message and all its copies from your system. Any unauthorized use, copying, distribution, disclosure or reliance on any information contained in such message is strictly prohibited.  

SECTION B. PRIVACY POLICY

While you subscribe to our news, apply to our vacancies, share your business cards/contact details with us or just write to us, we collect some information about you. This Privacy Policy describes what information Marchenko Danevych collects about you, why we collect it, whom we may need to share it with, and what you can do to influence how we use information about you. 

This Privacy Policy should be read and interpreted together with the Terms of Use. 

When you share information about yourself with us, you give us your explicit and unambiguous consent to processing of your personal data on conditions described in this Privacy Policy.

(1) For what purposes may we use your personal data?

We use personal data collected via our website or otherwise voluntarily supplied to us by you only for the following purposes:

COMMUNICATION – to respond to your e-mails or to provide information (including our newsletters) at your request 

PR – to invite you to events which we think you may find interesting based on preferences you indicated in our previous communications (also in your subscription )
     – to register you for our events at your request

We use a photographer for all events organized by us. By registering for our event, you agree that your photos may be taken during the event and shared on our official website or at our pages on facebook.com and/or linkedin.com for the purpose of covering the event in the media.

HR – to consider your internship or job applications and, if your application is successful, to hire you/accept you as our intern 

Considering your internship/job applications may include reviewing information about you from public sources to gain an understanding of who you are before our interview and see whether there are no conflict of interest concerns; we are fully aware that information on your personal life may not be used to prove or disprove your capabilities as an employee.

WEBSITE – to maintain our website and to gather analytical data about website performance

OTHER – for other legitimate purposes if such use is in line with the above purposes or if such use is required by the law.

We will not use or share the information about you for any other purpose, unless you agree to such use or sharing.

(2) What information can we collect about you?
We may process and collect the following information about you:

- your first and last name, position, place of work, and e-mail (if you subscribe to newsletters and news from us), and/or
- photos with you from events organized by us,
- any other information which you voluntarily share with us in any form (e.g. information about you from your internship or job applications, information you give to us when you register for our events, etc.).

We never collect any sensitive information about you (e.g. health data, data on your race or ethnic origin, etc.).

(3) Does your website use cookies?

Yes.  

Cookies are small files created by a website and stored on your computer that contain your individual preferences for using this particular website. Upon your repeat visit, your computer sends your preferences back to the website. In this way, this website “remembers” your preferences and adjusts its functionalities to personalize your viewing experience.

We use cookies to monitor website performance and customize the website for you. We do not use them for advertising purposes.

(4) Who is the controller of your personal data?

Marchenko Danevych is the controller of your personal data collected via this website or any other personal data of yours that you voluntarily share with us. 

(5) Who may we share this information with? 

We may need to share information about you that you voluntarily share with us with outside parties, including but not limited to:
- the website administrator,
- our IT service providers,
- if you register for our events as a participant/speaker, – to other participants/speakers of the event and/or with the event organizer, if we decide to engage one,
- for purposes of gathering website analytics, – to respective apps/programs (their owners) (e.g. Google Analytics),
- law enforcement or government bodies, if expressly required and authorized under the law.

Some of these outside parties may process your personal data at our request on our behalf (“data processors”).

We take great care in selecting our business partners (website administrators, event organizers, etc.). We do not work with counterparties that do not undertake to ensure strict confidentiality and maximum possible security of personal data we are processing. 

We will not share your personal data with anyone unless it is in line with the purposes with which we collected your personal data (unless the law obliges us to do so). 

(6) Do we send information about you outside of Ukraine?

Servers on which your personal information is stored may be located outside of Ukraine (including but not limited to Germany). 

Thus, information about you that we process may be transferred outside of Ukraine, including to countries that under the Ukrainian legislation do not accord the appropriate protection to your personal data. We will not notify you of each instance of transfers of your data abroad but we undertake to ensure to the best of our ability that your personal data are at all times adequately protected and secure, particularly through respective provisions in contracts with our business partners. 

(7) For how long do we store information about you?

We will not store your personal information for longer than is required to achieve the purposes for which we collected such information, unless longer storage is required by the law. 

We will not be able to notify you of every instance of making changes, deleting or destroying your personal data.

(8) What are your rights with regards to personal data we use about you? 

At any time you can:
- write to us to know more about how we use your personal data, or to make changes to the personal data we have about you,
- revoke your consent to the future use of your personal data by us by informing us about that to office@marchenkodanevych.com,
- appeal to the ombudsman (Representative of the Verkhovna Rada of Ukraine on Human Rights) or to court if you think that your rights under data protection laws are violated.

(9) Do we keep your personal information confidential and secure? 

We abide by and respect confidentiality of your personal data. 

We do not in any case transfer, or sell, or make available to any other person your personal data for commercial purposes, other than sharing with/giving access to our business partners for the above purposes. 

Contracts with our business partners provide for strict confidentiality and security of any personal data that is transferred and processed under such contracts. We do not contract with companies that do not agree to undertake strict confidentiality and security obligations regarding the personal data they may receive/access from us.
